Conditions of Sale

     

Goods are sold only subject to these conditions and upon the basis that they are at the customer’s sole risk, and so far as they may lawfully do so the manufacturer, distributor and retailer (their servants and agents) hereby exclude themselves from all liability in respect of all loss and damage and be bound by, or responsible for, any other conditions of sale, or any representations, specifications, promises, warranties or conditions of any kind or description expressed or implied statutory or otherwise.

    

Products may cause damage or loss if used otherwise than strictly in accordance with the directions for its use. Each user should conduct his own tests to determine the suitability of this material for his particular purpose.

     

Goods remain the property of the supplier until paid for in full.

We have attempted to provide suitable precautionary statements on all hazardous or suspected hazardous chemicals. In many instances chemicals have not been studied for hazard or toxicological effect. The burden for safe use of all our chemicals is the sole responsibility of the buyer or user. Our products are intended to be used by individuals who are familiar with their potential hazards. Individuals using these materials should refer to the Material Safety Data Sheet (MSDS) and product labels for applicable warnings and safe use. One should always work in a well ventilated area when handling all chemicals.

           

Returns

     

Any item deemed defective by TopMark Products will be replaced or an adjustment made. Notification of defective products must be made to TopMark Products within 7 days of receipt. Returns not authorised by TopMark Products will not be accepted for credit. Any product selections suggested by TopMark Products employees are given to the best of their knowledge. Returns will not be accepted as a result of these selections.

           

GST

     

All prices quoted are ex our Auckland office, and are quoted in New Zealand Dollars. These prices include GST. Goods and Services Tax is charged on all products as legally required, regardless of shipping location.
